1.1 All
bookings accepted by us are subject to these terms and conditions.
1.2
Reference to Sunshine Villa Floridaor US refers to the owners: J Skipp, and J A Skipp, and/or
the home management agents RMG Orlando Villas. The client is you, the renter or
that person who pays the refundable security deposit.
2 Booking
procedure and payment terms
2.1
Clients must complete the Booking Registration Form and return it promptly. The
deposit must be paid at the time of booking through our Home-Away On-Line
facility (or other online service), a “Payment Request” will be emailed to you
to facilitate the payment, or, where time permits, deposit payments can also be
accepted by bank transfer or £sterling or US$ cheque made payable to J Skipp
for the amount quoted.
2.2 Any provisional booking will
be held for seven days pending receipt of the signed Booking Registration Form and
deposit in respect of the accommodation. A booking will be considered firm when
the deposit has been cleared to our HomeAway, Flipkey or bank account and we
have confirmed the booking in writing to the client.
2.3
The full rent is due 65 days before the date you arrive at the home. Optional
items are listed on the booking form and the charge for these services is
payable with the rental unless otherwise stated. No reminder will be issued.
Bookings made within 65 days of arrival are payable in full at the time of
booking, together with the security deposit, through the on-line booki8ng
facility or other agreed method. The deposit will become the refundable
security deposit when the rental charge is paid. Security deposits will be
returned to the client within 2 weeks of vacating the property in good order,
see clause 4.10
2.4
You may change your booking where practicable, -in which case we will make
every effort to accommodate any requests. There may be a £20 administration fee
for this service.
3
Cancellation
3.1
The client may cancel the holiday booked at any time after it has been
confirmed. Cancellation must be in writing.
3.2
We reserve the right to cancel the holiday if payment has not been received in
accordance with clause 2.1 & 2.3 above.
3.3
The following cancellation charges will apply to all rentals cancelled in
accordance with clauses 3.1 and 3.2 above:-

than 65 days prior to departure -

30 to 65 days -
50% of total rental
Within 30 days -
100% of total rental
3.4
In the unlikely event that circumstances beyond Sunshine Villa Florida’s
control necessitate the cancellation of the rental arrangement, Sunshine Villa
Florida will endeavour to find an alternative accommodation through its agents,
but reserves the right to cancel any bookings at any time and will only be
liable to refund monies already paid to US by the Client.
4
Accommodation
4.1
The accommodation provided is only for the use of persons named by the client
on the Booking Registration Form, subletting, sharing or assigning are
prohibited.
4.2
The property will be available to clients from 4p.m. Florida time on the day of
arrival unless otherwise agreed. All accommodation must be vacated by 10 a.m.
Florida time on the day of departure, unless a late departure is agreed and
paid for in advance.
4.3
An adult must accompany persons under the age of 21.
4.4
We will not be liable for any loss or injury resulting from the use of the
property, its contents, games room or pool.
4.5
Swimming pools are dangerous and ours is not to be used by children without
responsible adult constant supervision.
4.6
The home is in a largely residential area and improper or disruptive behaviour
will not be acceptable. Sunshine Villa Florida reserve the right to decline all
male or all female parties. Groups must be only of the size and persons
specified on the Booking Reservation Form. Failure to comply will render the
booking void and our managing agents have the right to evict your party from
the home and notify law enforcement authorities as appropriate.
4.7
The fences fitted to secure the pool area are fitted under State Safety
Regulations and are for your children’s safety and security. Children and
non-competent swimmers must have responsible adult constant supervision when
the fence is removed.
4.8 All electric, air
conditioning/heating, TV, towels, linens, utensils and kitchenware are included
as described in our brochure/website, except for optional items such as heating
the pool or safe rental etc as described on the Booking Form. We reserve the
right to modify the contents of the home at any time as necessary and replace contents
damaged or removed by guests, at our discretion. The photographs and
descriptions are accurate at the time of publication. The house inventory and
property (other than the cool box and beach toys) including towels must not be
taken away from the premises without express prior agreement.
4.9
The villa includes a baby-gym mat, stroller (pushchair), Greco travel-cot and a
high-chair. These items are included without charge but the renter undertakes
to use them only as per the manufacturers instructions, to thoroughly assert
their safety before use and to do so entirely at the renters own risk. The
renter must set them up and pack them away at the end of the vacation in
accordance with the manufacturers instructions, failure to do so will require a
specific visit by the management company which will be charged against your
security deposit.
4.10
The home is prepared and inspected prior to your arrival but should you find
any damage, breakage or anything amiss upon your arrival you must report it
immediately to the managing agents as in clause 6.1. Damage or breakage
occurring during your rental will be deducted from your Security Deposit as
described on the booking form.
4.11
ALL external doors must be kept shut when the Air Conditioning is switched on.
The A/C may be switched off at the thermostat if you wish to leave doors open.
Running the A/C with doors open can overload and shut down the A/C.
4.12
Guests must not park their vehicles on the grass. There are irrigation pipes
below which can be ruptured by the vehicle causing unlimited flooding, costs
and damage, which you will be responsible for.
5 Pool
Heating.
5.1
If pool heating is paid for, the electric heat pump will be turned on for when
you arrive. The renter must deploy the Solar Pool Cover each night. The pump
and heater will run from 9am to 6pm (approx.) each day. The thermostat will be
set to 85F and under normal circumstances and proper use this water temperature
can be expected after it has had time to warm-up, however, under colder weather
conditions the heat pump cannot raise the water temperature more than about
10-15degrees above the air temperature, and it may take longer than usual to
reach this temperature. The renter accepts this limitation and that we are not
liable should cold weather make it impossible to raise the water temperature to
the thermostat setting. Should cold weather make it impossible for the pool to
heat satisfactorily, the renter is at liberty to request that the heating be
turned off by contacting RMG Orlando Villas during office hours, and pool heat
charges will cease from when the heating is turned off, subject to a minimum of
3 days charge. Guests must not attempt to adjust or tamper with in any way, the
pool timer or heater, they are locked for a reason. Tampering will be
considered fraudulent and appropriate measures taken.
6 Complaints
6.1
In the unlikely event that the client has any reason for complaint or
dissatisfaction, they must contact Sunshine Villa Florida’s Management Company
caring for the property in Florida immediately so that remedial action may be

7 Smoking
7.1
For the comfort and safety of clients and guests, smoking is not permitted in
the home. Smokers may do so in the pool/patio area, ensuring the odours do not
drift into the house. You will forfeit your full security deposit to pay for
additional cleaning & deodorising costs if you or any of your party choose
to ignore this condition of booking.
8 Animals
and Pets
8.1
Animals and Pets are NOT permitted in the Home. This condition is strictly
enforced.
9 No Daily
Maid Service
9.1
While linens and bath towels are included in the home, daily maid service is
not included in the rental rate and you must keep the home, towels and linens
clean. We suggest you bring beach towels or buy them locally. We do not permit
towels or linens to be taken from our home. An initial supply of soap,shampoo,
toilet roll, and dishwasher tab is provided, replenishment of these and other
consumables must be supplied by you.
10 Hurricane
or Storm Policy
10.1
Florida has a semi-tropical climate and may be subject to hurricane or storm. The
client must take all steps to ensure the safety of themselves, their party and
the home/property. No refunds will be given unless:
a.
The National Weather Service orders mandatory evacuation in a "Tropical
Storm/Hurricane Warning area" and/or
b.
A "mandatory evacuation order has been given for the Tropical
Storm/Hurricane Warning" area of residence of a vacationing guest.
The
day that the National Weather Service orders a mandatory evacuation order in a
"Tropical Storm/Hurricane Warning," area, we will refund:-
a.
Any unused portion of rent from a guest currently registered,
b.
Any unused portion of rent from a guest that is scheduled to arrive, and wants
to shorten their stay, to come in after the mandatory evacuation is lifted; and
c.
Any advance rents collected or deposited for a reservation that is scheduled to
arrive during mandatory evacuation period.
11 BBQ/Grill
A
charcoal BBQ is provided free to use which must be used only by responsible
adults over 21 and competent with the safe use of BBQ’s. It must not be lit within the screened patio area and must be used only
outside in the open. It must be put away safe when cooled.
BBQ cleaning is not
included
in the rental charge. Should you choose to use the BBQ, it must be cleaned
thoroughly and hygienically by you before departure and stowed away in the
appropriate place in the garage. BBQ components (except utensils) must not be
cleaned in the dishwasher. Failure to clean the BBQ will force us to engage a
cleaning service specifically for this purpose which will result in the $85
charge being deducted from your deposit. In using the BBQ the client accepts
full responsibility for the BBQ and consequences of its use, and agrees without
reservation to these terms. Additional Terms apply if use of the optional gas
BBQ/Grill is requested.
12 Safety
and security.
The
home is fitted with a Smart Home safety and security system. This is to deter
and detect intrusion, and protect yours and our property. This includes
automated electrical items and an external camera on the front and rear of the
house. There are no internal cameras. Guests have the ability to turn off the
rear camera when using the pool.
13 Force Majeure
13.1
We can accept no responsibility for, and shall not be liable in respect of loss
or changes caused by force Majeure e.g. Strikes, Fire, Flood, Closure of
Airports, Weather Conditions, War, Riots, Terrorist Activity, theft, malicious
mischief or any other event beyond our control.
YOU ARE RESPONSIBLE FOR
ENSURING THAT YOU HAVE VACATION/ HOLIDAY/TRAVEL INSURANCE TO COVER CANCELLATION
OR OTHER LOSS OR ACCIDENT WHICH MAY OCCUR DURING YOUR VACATION.
